TERMS AND CONDITIONS
These terms and conditions (“Terms”) apply to the purchase of Fine Art Print(s) (“Fine Art Print(s)/Order”) either online, at www.eggtemperamovement.com (“Website”) or in person at our gallery show or event, and set out the terms of agreement (“Contract”) between Egg Tempera Movement Ltd., (“We/Us”) as seller and the customer/collector (“You”) as buyer. By using our services and placing an Order, You agree to be bound by these Terms.
PLACING AN ORDER | MAKING A PAYMENT
Please understand that each Fine Art Print is Custom Made To Order. The price, description and details of the Fine Art Print(s) are displayed on our Website. This information can change without notice.
The creation of each Fine Art Print is an individual process, finished by hand. Therefore, You agree to accept that the Fine Art Print(s) may slightly vary in size.
By placing an Order You accept the price shown and agree to pay the value of your Order. Payment is considered made once We receive cleared funds in the full amount.
Payments must be made by card using Stripe, a third-party payment provider. We do not store or process your card details and payments.
No Contract of sale shall exist between Us and You until We confirm the acceptance of your Order. Acceptance of your Order shall take place when We receive full cleared payment for your order and send you the Order Confirmation.
Please follow the onscreen steps on the Website to place your Order and provide Us with your complete and accurate details, such as name, delivery address, etc., for your Order to be successfully processed and fulfilled.
Since each Fine Art Print is Custom Made To Order, once You place your Order and make a full payment, please allow up to 30 working days for your Order to be sent to You. We will strive to have your Order ready for shipment within this period, but shall not be in anyway responsible should We find ourselves unable to meet this time frame, do to circumstance beyond our control. We will send you an email should there be a delay.
SHIPPING AND DELIVERY
Your Order will be sent directly to You through the post. Currently, domestic and international shipping is complimentary. This offer can become unavailable in the future.
Orders are posted by Royal Mail Tracked Service to UK and International destinations, or by any other delivery company We may prefer to use at the time. The delivery time depends on the delivery service, its international partners, customs clearance, should the Order be exported outside the UK, etc. We shall not be responsible for the delivery time frame.
Risk of loss and/or damage to your Order shall pass to You once the Order is transferred to the delivery company. As soon as risk is passed to You, you are responsible for the Order, including during the shipping process.
If your Order is exported out of the UK and sent to an international address, it may be subject to import charges. You shall be responsible for paying any and all fees and expenses associated with such an import transaction, including but not limited to import tax, customs duty, use tax, etc.
Since each Fine Art Print is Custom Made To Order, your Order cannot be returned or cancelled.
All payments will be considered non-refundable.
If you should discover a production defect in the Fine Art Print(s), you must contact Us within 24 hours of delivery of your Order. A claim of production defect must be submitted in writing to the Customer Service email provided during the Order process and the Fine Art Print(s) must be sent back to Us by mail at your own expense.
Should a production defect be recognized and confirmed by Us (at our discretion), we will send You a replacement.
The Fine Art Print(s) are created from original fine art painting(s) that belong to and are the property of their authors/fine artists Elena Vladimir Baranoff and Anastasia Elena Baranoff, they are protected by copyright and the copyright remains with their individual author/fine artist.
We are exclusively authorized to create the Fine Art Print(s) from the original fine art painting(s) of Elena Vladimir Baranoff and Anastasia Elena Baranoff.
You are purchasing only the Fine Art Print(s) as a product. You absolutely have no right to produce copies of the Fine Art Print(s) and/or their image (including photographs) in any way, shape or form, for any purpose whatsoever.
Should a claim arise in connection with these Terms, Egg Tempera Movement’s entire liability shall in no way exceed the amount You paid for the Order in question.
We shall not be liable to You for the inability to deliver your Order or for the delay, defect or damage to your Order that is caused by a situation beyond our control.
English law applies to the Contract between you and us. You agree that the English courts shall have exclusive jurisdiction to settle any disputes or claims.
